A New York federal judge denied Raw Story Media Inc. and Alternet Media Inc. the opportunity to salvage their lawsuit accusing OpenAI Inc. of violating copyright law by stripping thousands of protected news articles of certain information when using them to train its AI model.

Judge Colleen McMahon dismissed the outlets’ suit in November, holding they lacked concrete injury to bring it, and ordered that any amended pleading explain why the proposed changes wouldn’t be futile.
