Popeyes Biometric Privacy Lawsuit Removed to Federal Court

Popeyes Louisiana Kitchen Inc. removed a proposed biometric privacy class action it’s facing to Illinois federal court, arguing the jurisdiction is appropriate under the Class Action Fairness Act.

The lawsuit should be handled in federal court because the proposed multi-state class exceeds 100 members and because the amount in controversy exceeds $5 million, Popeyes argued in its notice of removal filed Thursday in the U.S. District Court for the Northern District of Illinois.

The Class Action Fairness Act grants district courts original jurisdiction over civil actions if those criteria are met, Popeyes argued.
