One eBay Sale Unlikely to Confer Jurisdiction

A non-resident corporation’s single eBay sale into California of an allegedly counterfeit cell phone case was probably not a sufficient basis to exercise personal jurisdiction over the company, the U.S. District Court for the Central District of California ruled March 4 (Otter Products LLC v. Custom Offshore Tackle LLC, C.D. Cal., 2:12-cv-09311-GAF-AJW, 3/4/13).

Judge Gary A. Feess ordered the plaintiff in this case, Otter Products LLC, to show cause why its trademark infringement and related claims should not be dismissed for lack of personal jurisdiction.
