A car dealership’s express misrepresentation to an Alabama resident that its vehicles hadn’t been used as taxis created the minimum contacts necessary to establish Alabama jurisdiction, the U.S. District Court for the Northern District of Alabama ruled Feb. 23 (Summit Auto Sales, Inc. v. Draco, Inc., N.D. Ala., 2:15-cv-00736-KOB, 2/23/16).
The dealership intentionally directed its allegedly misleading communications at the state through phone calls and online photographs and should have expected its conduct to have an effect in the forum, Judge Karon Owen Bowdre said.
