Judge Pours Cold Water on Net Neutrality Injunction Review

A senior Ninth Circuit judge questioned why the court should decide an appeal of a lower court’s preliminary injunction denial in a case challenging California’s net neutrality law.

The preliminary injunction, requested by industry groups representing a slew of internet service providers like Comcast Corp. and T-Mobile US Inc., was denied by a district court judge in February. In March, the groups turned to the U.S. Court of Appeals for the Ninth Circuit.

J. Clifford Wallace, a senior Ninth Circuit judge, questioned the wisdom of holding the proceeding in the first place, during oral argument.
