Hulu Wins Dismissal of Privacy Class Action Over Consumer Data Sent to Facebook

Hulu LLC prevailed March 31 in a proposed class action brought by users of its online streaming TV service who alleged the company wrongfully disclosed their video viewing selections and personal identification information to Facebook Inc. (In re Hulu Privacy Litig., N.D. Cal., 3:11-cv-03764-LB, 3/31/15).

Magistrate Judge Laurel Beeler granted Hulu’s motion for summary judgment and dismissed the case with prejudice, saying there is “no evidence that Hulu knew” that Facebook would gather and combine data equivalent to personally identifiable information under the Video Privacy Protection Act, 18 U.S.C. § 2710.
