High Court Turns Away Challenge to Fed. Cir. Overturning Jury

The US Supreme Court declined Monday to hear a meat slicer company’s challenge to the authority of the Federal Circuit to overturn jury verdicts in patent cases.

The US Court of Appeals for the Federal Circuit in October wiped out a Missouri jury’s $10.5 million verdict for Provisur Technologies Inc. based on alleged infringement by a German rival, Weber Inc. The court, which has exclusive jurisdiction over patent appeals, took issue with findings that one of the three patents in the case was infringed by Weber’s SmartLoader meat-and-cheese slicer, as well as damages testimony.
