Online daily deal service Groupon Inc. has violated the Lanham Act through “bait and switch” advertising for San Francisco-area tours on Google’s AdWords, according to a complaint filed by a San Francisco tour operator in the U.S. District Court for the Northern District of California March 17 (San Francisco Comprehensive Tours LLC v. Groupon Inc.).
According to the plaintiff, Groupon has purchased location-specific ad keywords for sponsored ads on Google, and also uses those phrases in the advertising text.
