The Federal Circuit affirmed the invalidation of two CyWee Group Ltd. screen-navigation patents Tuesday, finding in a precedential opinion that Alphabet Inc.‘s Google justifiably secured the patent death sentences at an administrative tribunal.
CyWee had argued that the acting Patent and Trademark Office head declined to review the invalidation decisions too late, but that view misconstrues statutory timelines, Judge Sharon Prost wrote for the majority.
“CyWee’s untimeliness arguments are meritless,” the opinion said. “The statutory provisions setting specific deadlines for institution decisions and final written decisions say nothing of deadlines for any further Director review of those decisions.”
