Google Wants Out of Restaurants’ Online Ordering Trademark Suit

Google LLC is looking to dismiss a proposed class action claiming that its “Order Online” button that appears when browsing for restaurants on its search engine violates trademark and false advertising law.

The search engine’s use of restaurant names and trademarks to create digital storefronts displayed to consumers ordering food online is allowed under the fair use doctrine, Google argued in a motion to dismiss filed Monday.
