FSSolutions Ducks Claims Over Faxes Requesting Medical Services

Faxes requesting medical services don’t constitute unsolicited advertisements under the Telephone Consumer Protection Act, a federal judge in Illinois ruled, dismissing a chiropractor’s claims for unwanted faxes.

Dr. Richard Thalman, of Thalman Chiropractic & Wellness Center, sued FSSolutions after allegedly receiving two unsolicited faxes from the drug and alcohol testing company expressing interest in using Thalman’s facility for testing services. The faxes sought to add Thalman to a database so FSSolutions clients could use his services, and provided prices that the drug testing company would pay Thalman for each service.
