Filter Company Moves to Ax Proposed Data Loss Class Action

An air and water filter company is fighting back against a proposed class action in a North Carolina federal court stemming from a cyberattack, arguing the case should be dismissed because the plaintiff doesn’t have standing and failed to state a claim.

Plaintiff Jennifer McCreary lacks Article III standing because she didn’t show monetary loss or imminent future fraud related to the loss of her personal information, lawyers for Filters Fast LLC argued in their motion to dismiss filed Jan. 29 in the U.S. District Court for the Western District of North Carolina.
