Cannabis Delivery Company Escapes Class Action on Text Messages

California cannabis delivery company Xaler won’t have to face a class action alleging it sent consumers unwanted automated text messages, because the plaintiffs failed to show there’s a large enough potential class, a federal court in Los Angeles said.

Plaintiffs Alex Derval and Morgan Simmons claim that Xaler causes text advertisements to be sent to consumers’ cell phones even after the recipients ask them to stop, and that these messages violate the Telephone Consumer Protection Act.
