Vidal to Again Review VLSI Patent Probe After Remand Order (1)

A VLSI Technology LLC patent underpinning a multibillion-dollar verdict against Intel Corp. is again heading for US Patent and Trademark Office Director Kathi Vidal’s desk, as she announced Monday she’ll take a closer look at a tribunal’s second decision to review the patent’s validity.

The Patent Trial and Appeal Board on Friday found that OpenSky Industries LLC presented “a compelling, meritorious challenge” to VLSI’s US Patent No. 7,725,759 even after Vidal had directed the board to revisit its initial decision to accept the review petition, analyzing it under a higher standard for institution.
