The trial court properly refused to let a textile seller banned from eBay file a sixth amended complaint to belatedly include vague, unarticulated Sherman Act monopolization allegations against eBay, according to a Jan. 29 unpublished opinion from the California Court of Appeal, Fourth Appellate District (Ruins-CA v. eBay Inc., Cal. Ct. App., G045540, 1/29/13).

Ruins-CA and Lisa Genesta filed suit in California court against eBay, Inc. and several of their competitors in the retail “vintage” textile business. They alleged an anticompetitive scheme to discredit Ruins by getting it booted from selling its wares on eBay. ...
