Audible Inc. must face claims it excluded rivals from the audiobook retail market, after a federal judge said the plaintiff sufficiently pleaded antitrust injury.
Judge Jennifer L. Rochon of the US District Court for the Southern District of New York on Wednesday denied Audible’s motion to dismiss a case brought last year by CD Reiss, a self-published author.
“Reiss has sufficiently identified the practices complained of and the reasons the practices are or might be anticompetitive,” Rochon said.
