Attorney Who Says Ex-Spouse Accessed Her Work Emails Can Sue Him

A Washington attorney, who claims her ex-husband accessed her law firm email account, saw her Stored Communications Act case against him revived Tuesday when the Ninth Circuit said the trial court wrongly rejected some of her evidence.

Andrea Clare said that Kevin Clare insisted on access to her email, mobile phone, and text messages during their marriage but that she eventually told him to stop. One night while Andrea slept, Kevin allegedly used her thumbprint to unlock her phone, accessed her work email, and forwarded several emails to himself.
