The US Tennis Association will shake off a proposed class action filed in federal court in Manhattan alleging its website violates the Americans with Disabilities Act, after the plaintiff voluntarily dismissed the claims Tuesday.
“No settlement of any kind was reached,” counsel for USTA, Jeff Carton with Denlea & Carton LLP told Bloomberg Law. The plaintiff “dismissed his complaint with prejudice following the filing of our motion to dismiss,” he said.
Counsel for plaintiff Robert Weekes didn’t immediately respond to requests for comment.
