Student Accused of Sexual Harassment Must Arbitrate Bias Claims

An ECPI University student can’t pursue in court claims he was subjected to a hostile educational environment based on sex when he returned following a one-semester dismissal after being falsely accused of sexual harassment.

The university, also known as East Coast Polytechnic Institute, and six individual defendants were correct that Joseph Talley must arbitrate his Title IX of the 1972 Education Amendments, Title VII of the 1964 Civil Rights Act, South Carolina Human Affairs Law, breach-of-contract, and due process claims, Judge Jacquelyn D.
