Ninth Cir. Halts Use of Force Limits Against Portland Protesters

A court order barring federal immigration officers from using excessive force against protesters outside an Oregon immigration detention center was halted by a federal appeals court.

A split panel of the US Court of Appeals for the Ninth Circuit granted an administrative stay Wednesday and ordered expedited briefing on the federal government’s emergency motion to stay the preliminary injunction pending appeal. But Judge Ana de Alba said in a dissent that the government “has not demonstrated that an administrative stay is warranted,” nor did it “show a sufficient exigency to justify changing the status quo.”
