A federal judge shot down a lawsuit from the brother of the late singer of the Ramones because his dispute with the widow of another band member over the punk band’s trademarks is covered by a binding arbitration agreement.
The US District Court for the Eastern District of New York lacks subject-matter jurisdiction but declined to construe Linda Cummings-Ramone’s motion to dismiss as a motion to compel arbitration, Judge Margo K. Brodie wrote in an opinion issued Thursday. Brodie said she didn’t compel arbitration because Cummings-Ramone hadn’t asked for an order for it.
