Burger King Worker Alleges Sex, Not Race, Harassment in Lawsuit

A former employee at a Burger King franchise in Kansas failed to state a racial harassment claim through her allegations that negative stereotyping in the U.S. of Black women as hyper-sexual deviants and commodities contributed to a work environment in which her male manager preyed on her, a federal judge ruled.

Those are the sort of conclusory allegations that don’t state a plausible claim under federal pleading rules, the U.S. District Court for the District of Kansas said.

Kenya Watkins doesn’t allege that general manager Michael Jackson’s harassment included any race-based remarks, Judge Julie A. Robinson said.
