Synacor Beats Investor Bid to Revive Suit Over AT&T Contract

Synacor Inc. successfully fought off an attempt to give new life to a would-be class suit alleging the company misled investors about a contract with AT&T Inc. after the Second Circuit affirmed dismissal of the case.

The district court correctly determined that the challenged statements, “phrased in terms of Synacor’s expectations and projections for the future, were quintessential opinion statements” and inactionable, the U.S. Court of Appeals for the Second Circuit said in an unpublished opinion.

Investors accused Synacor in 2018 of misleading them about the value of a new contract to host AT&T’s web services.
