The district court correctly determined that the challenged statements, “phrased in terms of Synacor’s expectations and projections for the future, were quintessential opinion statements” and inactionable, the U.S. Court of Appeals for the Second Circuit said in an unpublished opinion.
Investors accused Synacor in 2018 of misleading them about the value of a new contract to host AT&T’s web services.
