Prosthetics Firm Hanger No Longer Free of All Fraud Claims (1)

Prosthetics maker Hanger Inc. must keep litigating investor allegations of misleading statements about Medicare reimbursements and audits after an appellate court said the district court should’ve considered some of the claims.

Hanger investors sued the company and three executives for allegedly “reporting inflated financial results” for several years and overstating the success of its Medicare audits and appeals, according to an Aug. 6 U.S. Court of Appeals for the Fifth Circuit opinion. The U.S. District Court for the Western District of Texas had dismissed the claims, but the Fifth Circuit said some of them should go forward.
