The U.S. District Court for the Northern District of California declined Jan. 10 to stay a Securities and Exchange Commission’s administrative subpoena requiring Google.com to disclose the identity of the holder of certain Gmail accounts suspected of playing a role in a multimillion-dollar securities fraud (Doe v. SEC).
The “relevant factors do not weigh in favor of a stay,” Judge Charles R. Breyer concluded.
In a footnote, he noted that there actually are three motions before the court in three related cases—Nos. 11-80184, 11-80208, and 11-80209. “The facts are nearly identical in all three motions.”
