Marriott Beats Investor Bid for New Shot at Data Breach Dispute

Marriott International Inc. investors who say the company misled them about data vulnerabilities connected to a major breach of guests’ personal information failed to allege that the statements were false or misleading when made, the Fourth Circuit said Thursday.

Investors accuse the hotel chain of omitting material information about severe data vulnerabilities at Starwood Hotels & Resorts Worldwide Inc., which Marriott acquired in 2016. The would-be class didn’t adequately allege that any of the challenged statements were false or misleading at the time Marriott made them, the U.S. Court of Appeals for the Fourth Circuit said.
