Fox Factory Prevails in Covid-19 Bike Demand Investor Suit Again

Fox Factory Holding Corp. ended with finality allegations it misrepresented continued demand for its bicycle and specialty vehicle parts following Covid-19, after a federal judge said the lead investor’s attempt to replead was deficient.

Investor Ryan Marselis’ repleaded complaint failed like a prior one, given he “returned with mostly cosmetic changes,” Judge Thomas W. Thrash Jr. said. Marselis again failed to adequately allege any of Fox Factory’s statements were misleading because he lumped them together, the US District Court for the Northern District of Georgia judge said, ordering the case closed Tuesday.
