Ex-Cantor Fitzgerald Broker Overcomes SEC Bid for Quick Win

A former Cantor Fitzgerald & Co. broker accused of circumventing commission payment procedures survived the SEC’s bid for an early win after demonstrating material facts are still in dispute, a federal judge in New York said.

Adam Mattessich allegedly aided and abetted books and records violations by scheming with two other traders at the firm to secretly split commissions. The Securities and Exchange Commission established a primary violation of the compensation record rule, but whether Mattessich knew and substantially assisted are still in dispute, the U.S. District Court for the Southern District of New York said.
