Elkhorn Capital, Founder Fight Off Investors’ Marketing Pay Suit

Elkhorn Capital Group LLC and founder Benjamin Fulton again beat claims of misleading investors about an annual marketing payment after a Delaware federal district judge dismissed the suit with prejudice.

Keystone Associates LLC and Cable Mountain Partners LLC accused Elkhorn and Fulton of securing their investments with a false promise about a $500,000 yearly marketing payment. But the investors haven’t shown that the alleged misrepresentations caused their $2.5 million loss, the U.S. District Court for the District of Delaware said Tuesday.
