Chemours Loses Bid to End Case Over DuPont Spinoff, PFAS Costs

Chemours Co., its chairman, and its CEO must face securities fraud litigation over claims they kept investors in the dark about the billions in potential environmental liabilities the company took on when it spun off from chemicals giant DuPont Co., a federal judge in Delaware ruled.

Judge Colm F. Connolly let the case move forward Thursday in the U.S. District Court for the District of Delaware, saying it’s plausible the company and its leaders continued to publicly tout nine-figure high-end liability estimates even after they secretly learned the amount could actually exceed $2 billion.
