Checkpoint Therapeutics Inc. defeated investor claims it concealed the likelihood US regulators would deny its skin cancer treatment’s application due to its manufacturer’s compliance problems, a federal judge ruled.

Most of the purportedly misleading statements about the Food and Drug Administration’s approval process for its therapy cosibelimab were unactionable puffery, opinion, or forward-looking projections, Judge Paul A. Engelmayer said as he tossed the investor’s proposed class allegations with finality Monday.
