Boeing Implores Appeals Court to Revoke Investor Class Status

Boeing Co. investors needed to provide a specific methodology for measuring classwide damages before being certified as a class suing over jet safety statements rather than being allowed to present one later, the airplane-maker told an appellate court.

The pension funds leading the suit shouldn’t have gained class status simply by presenting a “generally applicable out-of-pocket standard,” the company said. That doesn’t satisfy standards set by the Supreme Court’s decision in Comcast Corp. v. Behrend, according to its brief filed in the US Court of Appeals for the Fourth Circuit on July 18.
