Biogen Ordered to Give Files to Investor Probing Kickback Claims

A Biogen Inc. shareholder has the right to internal files showing what its leaders knew about kickback and retaliation claims that led to major legal problems, including a Justice Department investigation, a Delaware Chancery Court judge ruled Wednesday.

Vice Chancellor Paul A. Fioravanti Jr. ordered the drug company to turn over materials related to the DOJ probe, its compliance efforts, any other policies or procedures “implicated” by the records request, and board independence.
