Attorney Sues SEC Over FOIA Request

The attorney of a former hedge fund manager who was ordered to pay a $62 million penalty to the Securities and Exchange Commission has sued the agency alleging that it failed to properly respond to a Freedom of Information Act request (Dorsen v. SEC, D.D.C., 13-00288).

In a March 5 complaint filed in the U.S. District Court for the District of Columbia, David Dorsen, attorney for Michael Lauer, said the SEC denied a request and failed to decide an appeal for documents that allegedly reflect the agency’s “decision” to take action against Lauer.
