Tyson Opens New Front in Fight Over Covid-19 Case Jurisdiction

Tyson Foods Inc.'s latest challenge to an order returning to state court a gross negligence lawsuit filed by workers infected and for one killed by the coronavirus has teed up the question of proper jurisdiction over such cases before two U.S. appellate courts.

Tyson on Thursday asked the New Orleans-based Fifth Circuit to overrule a Texas federal judge’s determination that the case filed by 11 meat processing plant employees—plus the estate of one dead worker—accusing company officials of failing to provide a work environment safe from the coronavirus belongs in the Shelby County, Texas, court where it was filed.
