South Carolina Suing OSHA to Stop Fine Increase Mandate (1)

The state of South Carolina is asking a federal court to prevent the US Occupational Safety and Health Administration from forcing the state to raise its fines for worker safety violations.

The lawsuit filed Monday with the US District Court for the District of South Carolina asks the court to enjoin OSHA from enforcing its requirement that state maximum and minimum fines match those of federal OSHA.

If the lawsuit succeeds, it could enable the other 27 states and territories with their own federally approved workplace safety agencies—such as Arizona, Wyoming, Indiana, and Virginia—to also set lower fine structures.
