Tyler Pipe Co. faces a US Labor Department lawsuit alleging violations of federal whistleblower protections after allegedly firing an employee who requested personal protective equipment, the DOL said Monday.
The pipe manufacturer allegedly terminated the Tyler, Texas, worker after they asked to use a respirator to protect them from smoke and fumes in the work area.
The department’s complaint, filed Aug. 18 in the US District Court for the Eastern District of Texas, asks for an order that Tyler Pipe make the employee whole for retaliation, the agency said.
The case is Sec’y of Labor v. Tyler Pipe Co., E.D. Tex., No. 6:23-cv-00418, complaint filed 8/18/23
