OSHA Defends Allowing Union Reps on Nonunion Site Inspections

A federal court should throw out a challenge to OSHA’s policy allowing union representatives to accompany inspectors at nonunion worksites because union advocates may provide valuable assistance, the Labor Department said in a Nov. 14 motion to dismiss (Nat’l Fed’n of Indep. Bus. v. Dougherty, N.D. Tex., No. 3:16-cv-2568, 11/14/16).

The motion is the government’s initial response to a lawsuit filed Sept. 8 in U.S. District Court for the Northern District of Texas by the National Federation of Independent Businesses.
