Nurses Union Withdraws Court Challenge of OSHA Virus Standard

The union National Nurses United has voluntarily withdrawn its court challenge to OSHA’s Covid-19 emergency temporary standard.

The union and the Occupational Safety and Health Administration on Thursday filed a stipulation of voluntary dismissal with the U.S. Court of Appeals for the Ninth Circuit in San Francisco. Both sides agreed to bear their own legal costs. Neither party immediately responded to questions about what led to the withdrawal.

The nurses’ challenge was one of two June 24 lawsuits over the OSHA measure, which was issued with the intent to protect health care workers from the coronavirus. A similar petition was ...
