The administrative law judge ruled Nortek Powder Coating LLC was in default because the company did not respond to communications after it filed a notice of contest.

The ALJ assessed the Occupational Safety and Health Administration’s total proposed penalty of $3,400.

OSHA issued a citation on Jan. 29 for alleged repeat violations of the standard for working on exposed energized parts, found at 29 C.F.R. 1910.242(b), and the standard for hazard communication, found at 29 C.F.R. 1910.1200(e)(1). Nortek’s president filed a notice contest, and the Occupational Safety and Health Review Commission docketed the notice on March 3.
