Legal Challenges to Beryllium Rule Merged at Eighth Circuit

Federal court challenges to OSHA’s pending beryllium rule will be merged into a single appeals court’s jurisdiction.

At least three challenges to the Occupational Safety and Health Administration’s rule will shift to the Eighth Circuit in St. Louis, according to motions filed Feb. 6 in related cases in the Sixth Circuit and 11th Circuit.

The Eighth Circuit is home to a pending legal challenge by Airborn Inc. and Mead Metals Inc. requesting review of the proposal Airborn, et al v. OSHA, et al, 8th Cir., No. 17-01124, 1/18/17.
