Judge Vacates OSHA Citation Against Texas Highway Contractor

A federal safety citation against a Texas road building company whose worker was struck by a car that drove into a work zone was thrown out by an administrative law judge.

The US Occupational Safety and Health Administration had proposed a $14,502 fine against Williams Brothers Construction Co., alleging it didn’t adequately protect workers on a Houston-area interstate project.

The agency alleged a violation of the Occupational Safety and Health Act’s general duty clause, which requires employers to provide workplaces that are free of known, potentially deadly hazards that can be feasibly corrected.
