The employer is contesting a three-item serious citation and a penalty of $15,800, for alleged violations of 1910.38(d), for failure to have and maintain an employee alarm system; 1910.95(c)(1), for failure to institute a continuing, effective hearing conservation program when employee noise exposures equaled or exceeded an eight-hour time-weighted average sound level of 85 dBA; and 1910.1200(f)(5)(i), for failure to label, tag or mark each container of hazardous chemicals in the workplace with the identity of the chemicals contained therein (14-0815).
