The panel hearing appeals of Occupational Safety and Health Administration citations issued a split decision on the meaning of “on or about” in federal workplace safety law.
At issue for the two members of the Occupational Safety and Health Review Commission was whether an OSHA citation against transportation company R+L Carriers Shared Services LLC in Manchester, N.H., had been issued one day past the six-month deadline to cite a violation.
The decision reminds employers and OSHA staff that last-minute citations may open legal doors closed to earlier filings.
