Mine Safety Agency’s Reach Goes Beyond Mines, D.C. Cir. Says (1)

The federal agency in charge of mine safety can issue citations for hazards not at a mine, a federal court ruled.

By a 2-1 vote, the US Court of Appeals for the District of Columbia Circuit Tuesday upheld the Mine Safety and Health Administration’s ability to issue citations for alleged mining truck repair dangers found at a maintenance yard located more than a mile from the nearest mining facility.

Judges Florence Pan and Robert Wilkins voted to support MSHA. Judge Justin Walker dissented.
