Eye Doctor Sued by Labor Department in Wake of Employee’s Firing

A New York ophthalmologist and his practice have been sued by the U.S. Department of Labor for allegedly firing an employee who raised concerns about the office’s lack of implementation of state-mandated protocols to protect workers from COVID-19, the department said in a press statement issued Thursday.

A whistleblower investigation by the Occupational Safety and Health Administration found that Dr. David Kwiat fired the employee the same day the health department contacted his office, Kwiat Eye and Laser Surgery PLLC, citing the employee’s contact with state officials as the reason, according to the department.
