Pennsylvania-based utility contractor Henkels & McCoy Inc. again is subject to a nearly $13,000 fine stemming from the death of a construction worker after the legal panel that hears appeals of safety cases upheld an OSHA citation.
The Occupational Safety and Health Review Commission in a 2-0 decision released Friday rejected claims that the death was because of employee misconduct and defective machinery.
The panel backed a $12,934 fine and a general duty clause violation claiming that Henkels & McCoy failed to keep bolts tightened on truck-mounted equipment used to remove utility poles—a digger derrick.
