Amazon Warehouse Workers Appeal Dismissal of Covid-19 Lawsuit

Seven Amazon.com Inc. warehouse workers in New York are appealing the dismissal of their federal lawsuit accusing the online retailer of creating a “public nuisance” by failing to adequately protect them from the coronavirus.

U.S. District Judge Brian Cogan in Brooklyn ruled on Nov. 2 that the federal Occupational Safety and Health Administration was better situated “to strike a balance between maintaining some level of operations in conjunction with some level of protective measures,” given courts’ lack of expertise in workplace safety and public health, and the risk that different courts could reach different conclusions.
