2nd Circuit Gives OSHA Partial Victory in Repeat Citation Case

A federal appeals court handed OSHA a partial victory when it vacated a review commission decision that could have limited what is considered a “repeat” violation of workplace safety rules.

The U.S. Court of Appeals for the Second Circuit in Denver on Wednesday vacated the decision by the Occupational Safety and Health Review Commission.

At issue was a June 2018 commission decision that the Occupational Safety and Health Administration and the Department of Labor believed would limit OSHA’s ability to issue citations for repeat violations.
