Zoloft Cases Head Back to State Court; No Fraudulent Joinder of Wolters Kluwer

Four cases in which plaintiffs are suing Wolters Kluwer over patient education warnings about the use of Pfizer, Inc.-made Zoloft have been remanded back to Pennsylvania state court because defendants didn’t establish they were fraudulently joined, the U.S. District Court for the Eastern District of Pennsylvania recently held (In re Zoloft (Sertraline Hydrochloride) Prods. Liab. Litig., 2014 BL 150183, E.D. Pa., 2014 BL 150183).

Plaintiffs in the cases, in addition to suing the drug maker, alleged that Wolters Kluwer Health, Inc. and Wolters Kluwer United States, Inc. authored inaccurate patient education monographs (PEMs).
